Terms of Use
The website located at www.dutchbydesign.nl is a copyrighted work belonging to DutchByDesign, Netherlands KVK Nummer 77558421 “Dutch By Design”, Certain features of the Services or Site may be subject to additional guidelines, under Frequently Asked Questions, that can be found on any order from the Services Page or Shop Page and Sitemap. All such additional terms, guidelines, and rules are incorporated by reference into this agreement below.
General
DutchByDesign is an online platform that offers clients online interior design services by submitting information about their 'the client' design projects including photos, and answers to questions and the designer who provides the services 'Dutchbydesign'. consultation, proposals, and providing online interior design services including shopping list with links, paint colour palettes & trim, style boards, tips and tricks, lighting styles, floor plan with 3-D sketches, and 3-D rendering plan. To the extent you are a Client the provisions in this agreement regarding Customers will be applied to you. You hereby represent and warrant that your User Content does not violate our policies. DutchByDesign is not obligated to remove any E-Design Projects, Decor Consultations, Portfolio Contents, Design Packages, Instant Library Design or Testimonials from the Dutch By Design Site unless required by applicable Law.
DutchByDesign is also not obligated to backup any User Content and it may be deleted at any time. You are solely responsible for creating backup copies of your User/Planners Content.
Information We Collect:
Personal Information: We may collect personal information such as your name, email address and payment information when you make a purchase, create an account, or subscribe to our newsletter.
In order to use the Service, you may be required to provide information about yourself including your name, email address, and other personal information. You agree that any registration information you give to DutchByDesign will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own. Your account must not be used for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction. The information given to Dutchbydesign will not be used by or sold by anyone outside of DutchByDesign. Information that is given to DutchByDeisgn is for the alone purpose for communication and delivering the planners. Any bank details and payment details are done by a third-party payment platform Mollie payment systems.
How We Use Your Information
a. Personal Information: We use your personal information for the following purposes: To process your orders and provide you with the products or services you requested. To communicate with you about your orders, promotions, and updates. To customise your shopping experience and recommend products tailored to your interests. To improve our website, products, and services.
Data Security:
Our website and data security with kept with WIX. Wix uses industry-standard security measures to protect your personal and non-personal information from unauthorised access, disclosure, alteration, and destruction. We do not keep any personal information other than what is kept in the database at WIX.com. We do not move or transfer, sell or give any personal details of our clients. At times when we are updating our website for changes in the taxation, we can use CANVA to create a billing service with your billing info.
Payments, Refunds and Cancellation
Payments are done Via Mollie Payment Platform. An Invoice will be automatically created and sent to your email. There are times where we have to update our Tax info on the website. If this is not working you will be manually issued and invoice 2 to 3 working days after the payment has been made. The Invoices are done by hand through CANVA at times. If you wish to enquire about this further, please email DutchByDeisgn. DutchByDesign may refund a buying customer/client if the Customer placed a duplicate order (or request) in error for the custom orders. DutchByDesign cannot guarantee colour accuracy as colors and textures may look different on walls and surfaces due to lighting and textures. Customers are responsible for verifying item sizes & measurements before ordering shopping list items. Customers are solely responsible for checking and verifying all Designer Recommendations before ordering shopping list items and/or implementing the recommendations from the Designer. Please see Furniture Fitting & Paint Colours Testing below for more information on this.
If a client make a dispute for half payment after having received our intellectual property and/or deliverables via email, phone, or downloads, and choose to dispute such charges through their credit card company; we will issue an invoice at an hourly work rate of 100 euros, plus any other expenses, deliverables already shared, and including legal fees, as you are paying for the time the designer spent on your planner this also includes Digital Downloads. If you dispute payment
we reserve the right to issue an invoice for all fees in question and at this point, all discounts are null and void. We will then pursue a claim through small claims court or through our legal counsel with a filed court complaint, or collections agency. We feel that if the situation reaches this point is no longer about the money it becomes a matter of principle.
Should DutchByDesign be forced to engage legal Counsel and or file a small claim to obtain payment, payment dispute, and or refusal of payment the client will then be responsible for all credit cards, bank fees, time billable, and legal, and/or filing fees. Should a client choose to dispute a charge or feel that they have not received the services they hired us for, and after DutchByDesign has done all that is reasonable within the agreement and scope of work- the client agrees at the time of purchase that they will choose mediation over litigation at all times.
Refunds are not given for digital work in both Pre-Made/E-Design Planners or Custom Orders. Custom Orders are calculated on the average time spent on the package. You are paying for the designer's time and not for the plan.
Payment and Delivery
Upon a Sale, the Buying Customer will pay the Customer Payment, the Designer will upload a draft version of the Buying Customers order. Once approved, the Designer will upload the Sold E-Design/Pre-Made Planner/Package will deliver the Sold E-Design Package to the Buying Customer via email. The “Customer Payment” is the price that the Designer set, this does include the taxes for The Netherlands.
The Delivery Order
Revision Services: Custom Designs are offered with revision services. It is important to understand that if you provide instructions regarding style and color, there is a possibility that you may not be satisfied with the outcome or like the style you had in-mind. In such cases, DutchByDesign will provide two free revision for changes in colour and furnishings that align with your requested style. However, please note that this free revision does not apply to a complete restyle of the design. If you request different styles that fall outside the scope of the initial design project, DutchByDesign reserves the right to refuse work on the order or charge an additional fee for a separate design.
Response Time: Timely communication is crucial to the success of the design project. If the client fails to respond to our inquiries or requests for feedback within a reasonable period, which shall not exceed [insert specific time frame, e.g., 14 days], DutchByDesign may consider the project void and no refund will be issued. It is essential for the client to actively participate in the revision process and provide prompt feedback to ensure the smooth progress of the project.
Refusal of Service: The provision of our Services is subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person, or entity, without the obligation to provide a reason for doing so. Please be aware that an order is not considered accepted until payment has been processed. We may, at any time, modify or discontinue any aspect or feature of the Site or Service, provided that we fulfill our prior responsibilities to you based on the acceptance of your payment.
Order Confirmation
We will email you to confirm the placement of your order and with details concerning product delivery. In the event that there is an error in this email confirmation, it is your responsibility to inform us as soon as possible.
No Price Guarantee
Vendor pricing is subject to change and out of the control of Dutch By Design. Dutch By Design cannot guarantee prices of merchandise, interior installation, or other services not performed by Dutch By Design.
Furniture Fitting & Paint Colours Testing
At Dutchbydesign, we are committed to providing you with ideas and links to furniture and decor items to help you create your dream space. However, we want to make it clear that it is ultimately the client's responsibility to ensure the suitability of these items for their specific needs. Please take note of the following:

Pain Colour & Texture & Wallpaper : While we strive to provide accurate representations of textures and colour shades, variations in screens and monitors may affect how these appear. We recommend verifying the texture and color shade by requesting samples and using a patch test visualise how the paint or wallpaper will look in your space.

Use of Our Measuring Info: We provided you an easy way to test how items will fit in your home. We encourage you to utilise this method to minimise the risk of any discrepancies between expectations and reality in sizes.

Possible Errors: Mistakes can occasionally occur in the presentation of 3D imagery, misunderstandings in measurements, or issues with model files. While we strive for accuracy, we cannot guarantee perfection in every aspect of our offerings why we ask you to follow our measuring info.

Liability Disclaimer: Dutchbydesign shall not be held liable for any purchases that do not match your expectations or do not fit within your home. We strongly recommend thorough research, measurement verification, and utilizing our planner info to minimise the likelihood of any issues.
By using our services and making purchases through our website, you acknowledge and accept the responsibility for ensuring the suitability of the products for your specific requirements.

WE ARE NOT RESPONSIBLE FOR THE SELLERS FROM THE PRODUCTS LISTED IN THE SHOPPING LISTS. PURCHASE AT YOUR OWN RISK. DUTCH BY DESIGN IS NOT RESPONSIBLE FOR ANY LOSS OR DAMAGES THAT HAVE INCURRED BETWEEN THE INTERACTION OF THE SELLERS/ SHOPS FROM THE SHOPPING LIST OR FROM THE AFFILIATION STORE LISTS. WE DO NOT TAKE ANY RESPONSIBILITY IN ANY INJURY, DEATH OR ACCIDENTS FROM ANY INFORMATION GIVEN OR PURCHASES. iT IS UP THE THE CLIENT TO USE COMMON SENSE AND READ THE SAFTY INSTRUCTIONS ON ALL MATERIALS, FURNITURE AND PRODUCTS.
Copyright and IPR
You also agree that Designer may use their design ideas, including but not limited to their Design Proposals and E-Design Packages in more than one place. Customers do not own the Intellectual Property Rights that the Designer produces. Instead, the customer is only purchasing the service that is custom to design and styled for you. We retain the right to re-use any of the design planner for instant plans, advertising, social medias or even recycle for other planners.
